Terms and Conditions

Acceptance of Terms

By using the services provided by Kyuka, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before booking or using any services.

Eligibility

You must be at least 18 years old to make a booking at Kyuka. By using our services, you confirm that you are eligible to do so.

Booking and Payment

Bookings at Kyuka are only confirmed upon full payment of the reservation amount. We accept payments via credit/debit cards, UPI, and other digital payment methods as available on our booking platform.

Cancellation Policy

  • Cancellations made 7 days or more before the check-in date: Full refund, minus a nominal processing fee.
  • Cancellations made within 7 days of check-in: No refund will be issued.
  • No-show or early check-out: No refund will be issued.

Changes to Bookings

Changes to bookings are subject to availability and must be made at least 48 hours before the check-in date. Additional charges may apply for modifications.

Liability

Kyuka is not responsible for any injuries, loss of property, or incidents occurring on the premises, except where required by applicable law. We take all reasonable steps to ensure your safety and comfort during your stay.

Conduct

Guests are expected to behave respectfully during their stay. Kyuka reserves the right to terminate a guest’s stay if they engage in behavior that disrupts the peace and comfort of others.

Intellectual Property

All content on this website, including but not limited to text, images, and logos, are the property of Kyuka and may not be used without permission.

Force Majeure

Kyuka is not liable for any delays or failure to perform services due to unforeseen events, including natural disasters, pandemics, government restrictions, or other acts beyond our control.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

Reservations and Bookings

  • Booking Confirmation: Reservations are confirmed upon receipt of full payment only.
  • Cancellation Policy:
    1. 100% Refund: For cancellations made 14 days or more prior to the arrival date.
    2. 50% Refund: For cancellations made between 7 and 14 days prior to the arrival date.
    3. No Refund: For cancellations made within 7 days of the arrival date.
  • Amendments: Requests for date changes are subject to availability and will be reviewed and confirmed by management on a case-by-case basis. No date changes or refunds will be entertained for any stays during the Diwali (17 – 26 Oct), Christmas (19 – 25 Dec) and New Years (26 Dec – 1 Jan) periods
  • Check-in/Check-out Times:
    1. Check-in: 3pm.
    2. Check-out: 12pm.

Guest Conduct & Responsibilities

  • Respect for Property: Guests are responsible for the care and maintenance of the property and its amenities.
  • Noise Levels: Guests are expected to maintain reasonable noise levels and avoid disturbing other guests.
  • Prohibited Activities:
    • Smoking is strictly prohibited inside the rooms. Smoking is permitted only in designated outdoor gazebos.
    • Alcohol consumption is not permitted in the common areas of the resort premises.
    • Bringing non-vegetarian food items, is strictly prohibited. The resort offers a delicious vegetarian menu.
    • Guests are responsible for the supervision of their children at all times. Due to the resort’s elevated location and natural surroundings, children must be closely monitored for their safety.
    • Illegal activities, including the use of drugs or illegal substances, bringing and consuming non-vegetarian food are strictly prohibited and will result in immediate termination of the stay without any refund.
  • Guest Responsibility: Guests are responsible for any damage caused to the property, including but not limited to, damage to furniture, fixtures, bedding, linens, and any other resort property.
  • Indemnification: Guests agree to indemnify and hold the resort harmless from any and all claims, liabilities, losses, damages, and expenses (including attorneys’ fees) arising from or relating to any damage caused by the guest or their guests. Resort holds the right to charge the guest for the cost of repairing or replacing any damaged property.

Children & Infants

  • Child Policy: Children are welcome at the resort, however, they must be under the constant supervision of their parents or guardians at all times. The resort is not responsible for any kind of mishaps occurring due to negligence.

Food & Beverage

  • Dining Options: The resort offers a delicious vegetarian menu.
  • Outside Food & Beverages: Bringing non-vegetarian food items, is strictly prohibited.

Amenities & Services

  • Use of Amenities: Common areas are accessible by all guests. Kindly be mindful to not disturb other guests.
    1. Firepit: Kindly inform our staff 30 minutes before you wish to use the firepit areas.
    2. Jacuzzi: Kindly request our staff 1 hour before if you wish to use the Jacuzzi.

Internet, Mobile & Power Connectivity

  • Wi-Fi Access: Complimentary Wi-Fi is provided throughout the resort. However, please note that internet connectivity may be subject to occasional interruptions or variations in speed.
  • Network Availability: Please note that mobile phone network coverage may be unavailable or  limited for some providers within the resort due to its location.
  • Power Supply: The resort is located in a rural area, and occasional power outages may occur. While we have a backup generator, prolonged power outages may affect certain services.

Liability Disclaimer

  • Disclaimer of Liability: The resort shall not be liable for any loss, injury, or damage to guests or their belongings.
  • Force Majeure: The resort shall not be liable for any delays, cancellations, or disruptions caused by unforeseen circumstances beyond its control (e.g., natural disasters, strikes).
  • Natural Surroundings: Guests acknowledge that the resort is located in a natural environment and may encounter insects, wildlife, or other natural occurrences.

Drone Policies

  • Drone Usage: The operation of drones within the resort premises is permitted only with prior permission from the resort management.
  • Guest Responsibility: Guests operating drones are solely responsible for ensuring safe and responsible operation, adhering to all applicable laws and regulations, and minimizing any disturbance to other guests.

Governing Law & Jurisdiction

  • Governing Law: In the matter of enforcement of any rights or remedies hereunder, in pursuance of this Terms and Conditions, the Courts of Pune alone shall have jurisdiction.
The signing guest(s) on signing this Terms of Residence, warrants that he has read and understood and is duly authorized to sign and bind himself, his principle, as well as each and every guest in his accompanying party including invitees (if any), to this terms and conditions of residence; and failing such authority, the signing guest(s) agrees to be personally liable to pay for the residence of guest in his accompanying party including invitees (if any) and/or for any claim or claims of whatsoever nature that may arise against the owners/operators of the Resort, their associates, servants, employees and/or any person connected whether directly or indirectly with the running of the Resort and/or fellow guests/invites which might have arisen out of harm, injury, death, or loss suffered whilst on the premises or property of the Resort and whether arising from an act or omission on the part of the owners/operators of the Resort, their associates, servants, employees and/or any person connected whether directly or indirectly with the running of the Resort. These terms and conditions are required to be agreed to by the Signing Guest(s) and/or his/her authority at the time of booking.
